Terms of Service (Athena Photography)

These Terms of Service (“Terms”) govern your use of athena.photography and any services provided by Athena Photography (“we”, “us”, “our”). By booking a session or using this website, you agree to these Terms.

1. Services

We provide professional photography and related services, including but not limited to:

  • Family, couples, portrait and event photography

  • Branding and commercial photography

  • Photo editing and retouching

  • Delivery of digital images and optional physical products (prints, albums)

Specific details of your session or project (date, duration, location, deliverables and fees) will be confirmed in your email correspondence, booking form and/or separate written agreement.

2. Booking and payment

  • A non‑refundable retainer or session fee may be required at the time of booking to secure your date and time.

  • Remaining balances (if any) are due by the date specified in your invoice or agreement.

  • Payments are processed through third‑party payment providers (such as Stripe or similar). By paying online you also agree to their terms and conditions.

  • Your booking is not confirmed until the required payment has been successfully processed and you receive a confirmation email.

3. Rescheduling and cancellations

  • If you need to reschedule, please do so as early as possible. Rescheduling is subject to availability.

  • Retainers/session fees are generally non‑refundable, but may be transferable to a new date at our discretion (for example in case of illness, severe weather or unforeseen circumstances).

  • If we must cancel your session for reasons beyond our control, we will offer to reschedule or provide a refund of any fees paid, excluding completed work or delivered products.

You can request a more detailed cancellation policy in writing for specific projects or events.

4. Client responsibilities

You agree to:

  • Provide accurate information when booking

  • Arrive on time and prepared for your session

  • Obtain any necessary permissions for shooting at specific locations

  • Supervise children and ensure everyone’s safety during the session

We are not responsible for delays or missed shots caused by late arrival, restrictions at the location, or circumstances beyond our control.

5. Creative control

By booking with us, you trust our artistic style and judgment. While we welcome your input and preferences, final decisions regarding composition, editing style, selection of delivered images and other creative matters rest with us.

We do not guarantee any specific pose, location, or number of images beyond what is stated in your package or agreement.

6. Image delivery and archive

  • Digital images are typically delivered via an online gallery within the timeframe communicated for your session.

  • Galleries are available for a limited period (for example, several weeks or months). We recommend downloading and backing up your images promptly.

  • We are not responsible for maintaining permanent archives of your files, though we may keep backups at our discretion.

7. Copyright and usage

Unless otherwise agreed in writing:

  • We retain the copyright to all images we create.

  • You receive a personal licence to download, share and print images for personal use (for example, on social media, in your home, or in personal albums).

  • Commercial or editorial use (including for business advertising, websites and campaigns) requires a specific licence or branding package.

You agree not to edit images in a way that misrepresents our work (such as applying heavy filters) without our consent.

8. Our use of images

With your permission, we may use selected images for our portfolio, website, social media, studio samples or marketing materials. If you prefer your images not be used publicly, please let us know in writing before your session and we will respect your choice.

9. Limitation of liability

While we take great care with every session, our liability to you for any claim relating to our services is limited to the amount you have paid to us for that session or project, except where prohibited by law.

We are not liable for indirect or consequential losses, such as lost income, emotional distress, or travel costs, arising from cancelled or rescheduled sessions or technical issues beyond our reasonable control.

10. Third‑party services

Our website and workflow use third‑party services (such as gallery platforms, payment processors and scheduling tools). We are not responsible for any issues arising from those services, but we choose reputable providers and work with them to resolve problems where possible.

11. Governing law

These Terms are governed by the laws of Victoria, Australia, and any disputes will be subject to the exclusive jurisdiction of the courts of Victoria, unless otherwise required by consumer protection laws.

12. Changes to these Terms

We may update these Terms from time to time. The “Last updated” date will reflect the most recent changes. By continuing to use our website or services after changes are posted, you agree to the updated Terms.
